It's about time someone came up with this, right?

Yours fondly,

Easy Soft”

Click here to watch a 2-minute video that shows you how PA family law software works.

If you're unable to watch the video, here are the highlights:

1. The practice of divorce law in Pennsylvania requires the generation of many support calculations: from tax adjustments, to shared custody, multiple families, child-care, healthcare, custodial paid alimony calculations.

2. It also requires a multitude of statements, including income & expense statements, high-income expense statements, inventory statements, health insurance statements, and the like.

3. It also requires legal forms intense with data: from general family law practice management forms, to matrimonial litigation documents, to regular correspondence.

With Easy Soft's EzSupport-PA, you basically put all of your case management needs in one place.
Our user-friendly software captures all of your case data, automates many of the calculations, and makes the rest easy to read and understand. E z Support-PA manages all of the important aspects of a family law practice, making them efficient, cost-friendly, and best of all, strategic for your clients.

The video shows you how to enter case data, how to generate child support and spousal support worksheets, how to try out multiple worksheet scenarios (or play with Worksheet Magic), and how to generate income, expense, and other mandatory statements, forms, and attachments.

Easy, right? We know. It's just like our name.

Divorce Settlement Tip #4: Alimony V. Child Support

Our first divorce settlement tip recommended that when calculating spousal support, you start with available cash, or disposable (after-tax) income.

Tip #2 recommended working backward from need—and staying as close as possible to each party's marital lifestyle.

Tip #3 was about putting dollar value settlements in the context of your client's bottom (not top) line.
Today, we're going to talk to you about tax evasion.

Well, no. Not really. That would be sort of illegal. But a clever divorce attorney does design his or her clients' settlements to be mindful of the taxable and deductible nature of alimony, or spousal support, versus the non-taxable, non-deductible nature of child support.

It's simple. Child support is non-taxable as income. It's also non-deductible as an expense. Alimony is both taxable and deductible. So alimony provides the benefits. Clearly, you want to weight your settlement offers towards alimony—and provide a win-win for all concerned…especially the children.

Without getting into the policy behind this distinction in the U.S. Tax Code (beyond the scope of this blog post), we can say this: you have significant room to maneuver.

There to help? Easy Soft's Divorce Financials.

Our divorce software for attorneys processes everything in a flash. You simply type in a figure for child support, and another for alimony. Then, you tell the machine how many scenarios you'd like to see.
A second later, all of the options will be splayed out before you—complete with payment amounts, payment labels, and net disposable income for each party.

Easy, right? We told ya. And you don't even have to pull an Al Capone.

Divorce Settlement Tip #3: The Bottom Line

Our first divorce settlement tip recommended that when calculating spousal support, you start with available cash, or disposable (after-tax) income.

Our second tip recommended working backward from need—and staying as close as possible to each party's marital lifestyle.

Our third tip? Don't evaluate a dollar value settlement on its face. Wait until after you perform the tax calculations. Or more correctly, wait until your technology does that job!

Alimony amounts are only important in context . The addition of $20,000 a year in alimony payments could actually put your client in a higher tax bracket—and counter intuitively worsen his or her situation. If your client's the payor, a lower payment might actually impart stronger benefits on the payee—if it keeps such payee in a lower tax bracket.

Another way of looking at this tip is that bottom line matters more than top line. The top line (an absolute figure) means nothing…that is, not until you find out exactly how it impacts both parties.

Luckily, Easy Soft's Divorce Financials software makes this easy. With our alimony comparison features, you can see readily—at a glance—how gradations in settlement amounts impact each party's after-tax bottom line.

Our easy-to-use, well reviewed and popular family law software makes it easy for you to pick a win-win situation, or at least a situation in which your client comes out a winner. With that, Easy Soft makes it easy to keep your eye on your client's bottom line.

Divorce Settlement Tip #2: Work backwards from need

As mentioned, we're not in the business of advising you how to practice divorce law—or any other type of law.

We are in the business of giving you ways to make your practice easier, more efficient, and stress-free.
Our first divorce settlement tip recommended that when calculating spousal support, you start with available cash, or disposable (after-tax) income.

Our second tip has to do with your goal. In any divorce action, you're meeting one another's needs—defined as the means to maintain each party's lifestyle as closely as possible to the marital lifestyle.

This is a two-step process. First, you assess each party's needs.

Did we say “each party?” Yes, we did. See, it doesn't do you any good to focus on what your client WANTS to pay or receive. You've got to get the other side to agree, too. So for a better success rate, start with each party's needs.

How do you do this? Ah, here's another tip. In this context, “need” is synonymous with “budget.” Here's where you look at your financial affidavits (for example, “case information statement” in NJ; “income and expense statements” in PA; “affidavit of financial information” in AZ; and “statement of net worth” in NY), and see what each party's weekly and monthly budgets are. These are hard-core essentials, versus luxury items.

The second step? Work backwards, computing a settlement amount based on these needs.

Using Divorce Financials Software, our leading family law software, you take this need amount and click on “Alimony based on receiver's budget.”

Then, you can compare five different scenarios (five different budgets) and see how they play out in terms of the real world impact of settlement.

Divorce Financials generates modeling. Not only can you then discuss each scenario with your client, you can also bring the page of scenarios with you to the negotiations table, and see immediately what the impact is of a given offer on your client's circumstances.

Divorce Settlement - Tip #1: Start With Available Cash

As a legal software company, we're not in the business of advising lawyers how to practice divorce law—or any other type of law.

We are in the business of giving you ways to make your practice easier, more efficient, and stress-free.
Your parties' faces and facts are unique every time. But there are a few things that remain constants as you advise your client towards settlement. It's our job to point some of these out, so that you can spend less time figuring them out—and more time doing what you're trained to do.

Case in point: When calculating spousal support amounts, you always start with available “cash,” versus gross figures.

What this means is that for every one of your clients, you've got to take gross income from multiple sources, and compute the value of after-tax liquid assets. You've got to compute the disposable income. If you don't start with this value, then all of your subsequent calculations are going to be wrong.

Divorce Financials Software , our leading family law software, is designed to compute tax impact in an instant—giving you a quick number with which to begin calculations—and negotiations. Applicable in all 50 states, our divorce software saves you time spent figuring out tax brackets, and doing basic—or complex—math.

And when your starting baseline is easy, so is the work that follows.

The New RESPA Rules & You

Ah, RESPA. How we love you. Let us count the ways.

First of all, we love our new good faith estimates—narrowed down to within a penny (or 10% of a penny) of our lives. There's nothing we love more than adding up Fed Ex charges, copy rates, and filing fees. Think we're kidding? We're dead serious!

Second, we love how long and convoluted our HUD Settlement Statement have become. Usually, we just hug ourselves in delight. Occasionally, we look at each other and say, “Oh U.S. HUD, is this really the best you can do? Bring it on!! We can handle it!” And we beat our chests with glee.

In all seriousness, we can take it. That's because we have Easy Soft's Easy HUD software. The software automates everything for your HUD 1 closing…and boy do we mean everything. Your HUD forms, your HUD closing statement, your disbursements, checking printing, your trust accounting, even your 1099-S reporting.

The software automatically figures out who gets what and how much, it makes the disbursement, and then—like some brilliant robot from the 22 nd century—it reconciles your closing ledger. Right there. On the spot. Have an adjustment? No problem. Fix the number, and run it again.

Easy HUD's power and ease are why thousands of real estate settlement agents in the U.S. use it—before, and after, the RESPA changes.

Tell a lender, “I use Easy Soft's Easy HUD software ,” and you get instant credits. It gives your lender a comfort level that doesn't exist if you've got a less comprehensive plan—or worse, no plan at all.

If you want to be as excited as we are, then give us a call, get a real person on the line, and find out how you can embrace the new RESPA, too!!

NY Divorce Software That Simplifies, Well, Everything

Changes in New York State divorce law in 2010 threw a few things out of whack.
We know. It's your job to stay on top of changes in laws and regulations. But it's also our job to keep our software rigorously up to date.

Enter E z Support-NY. New York family law software that creates a case management center for each of your clients. You can have your NY family law forms, your support and maintenance calculators and worksheets, and all case correspondence stored—and generated—in one place.

We love it, and we trust you will too.

You look at the lower left panel for your navigation tabs.

You go to “Case Info” to enter your case information: the wife, the husband, the children and their ages, etc.
You click on “Support Worksheets” to generate Child Support and Temporary Maintenance Worksheets. To print the worksheets, simply click “Print.”

You click “Add Worksheets” to generate a comparison of multiple worksheet scenarios. Make your changes for each scenario, save, and click on Summary to compare.

The data you've collected produces a statement of net worth—where all the calculations are generated for you. And you can add an unlimited number of expense items, asset items, and debit items—particularly useful for high net work individuals. The form automatically expands to accommodate your entries. To print, you just click “Print”.

At your command, any form you need merges with your captured case data. For example, you can click on “UD-6: Affidavit of Plaintiff.” The merged form is now nearly ready, after you answer just a few remaining questions.

All prepared documents can be saved as a PDF or Word document. They can all be emailed directly from the software, too.

Easy, right?

That's why we call it Easy Soft.

Your Little 1099-S Problem

It's nearing the end of January. Recession aside, it was a solid year for real estate closings. Thanks to Easy Soft's Easy HUD software , you generated your HUD settlement statements without a hitch. Your Legal Time and Billing is up to date, your Trust Accounts are flawless, your revenues are strong, and you're feeling organized and happy as a lawyer can be.

There's only one thing left to do. Your 1099-S filings. There's a stack of them lurking—like miniature panic buttons. The longer you wait, the more painful it seems.

Don't everyone groan at once.

For most real estate lawyers, the 1099-S is an annual bureaucratic task that can wait. And it does. Until, that is, it can't.

The good news? Easy Soft USA has an electronic filing service. It's free (for Easy HUD users). It's painless to implement. You just generate your forms as your clients close. And it's part of Easy Soft's Easy HUD software package.

And with that, your little 1099-S problem is gone.

Easy Soft's Easy HUD software gives you the option to enroll in our 1099S filing service for no extra charge. With this service, you file your 1099S statements as you close —and eliminate the mad rush to file them come December.

We show you how it works, by opening a case file for a recent closing. We click on 1099S . It's magic: the screen is already completed! You review your data to verify it, click on the Submit button, and sit back.
You don't even need to physically mail your form to the IRS.

Easy, right?

That's why we call it Easy Soft.

Trust Accounting Software Saves the Day

It's scary. The annual number of disciplinary actions - even disbarments - that arise out of client trust fund mismanagement.

Some are the result of careless mistakes - brought from bad escrow management practices . Few encapsulate actual intent. But then come the random auditors—and suddenly, you're in trouble.
Don't let it happen to you.

Using the below primer on trust accounting, you can put a few practical tips into practice immediately. We'll have you in compliance and prepared for a knock on the door from your state auditors.

First, which of the following funds belong in client trust accounts?

A) Real estate transaction funds, such as a down payment on a house
B) Personal injury settlements
C) Earned fees
D) Personal funds
E) Operating funds
F) Collections
G) Other settlements or judgments
H) Retainers and advances

The answer is A, B, F, G, and maybe H—depending on whether you've earned the advances or not.
If you knew the answers, the tougher question is, how do you put it into action?

You've got to a) keep all of your client's funds in separate accounts, b) make sure your client ledger doesn't have a negative balance (or you're in the red), and c) make sure everything's in the right account (trust v. operating) at all times. Then, at the end of the day, you've got to d) reconcile it all.

How do you know what to keep, and what you can toss? Often, trust account bookkeeping requires you to keep paper records of check stubs and expense receipts.

With Easy Soft's Easy Trust software, it is easy. The software guides you through each requirement, reconciling balances—even performing three-way reconciliations.

Don't lose sleep over trust fund accounting. Follow the above rules, and you'll always be prepared for an audit.

What Kind of Errors Can My HUD-1 Software Prevent?

Oh, human errors. They're so natural—and so unfortunately inevitable. If you don't think it can happen to you, think again. It doesn't matter how careful you are, or how many times you go over your data, your numbers, and your deals. But the human eye can't catch everything—and everyone makes mistakes. Sometimes, the error isn't yours: it's the mortgage company's, or the title company's. So let us count a few wrongs!

Common Scenario #1 . Let's say you are creating a new HUD closing statement . Your modus operandi is to take an old HUD settlement statement , and pop your new numbers into the various fields. But have you ever done something like this, and found the old numbers hanging around? Perhaps they're in fields that you thought you changed, but didn't. Perhaps they're in fields that were inapplicable to the new deal—but haven't been deleted. Needless to say, this kind of approach is ripe for error—and can ripple throughout a deal.

Easy Solution 1 : Easy Soft's Easy HUD Software captures all case information at the outset—using a fresh set of HUD forms and other documents. You never have to worry about the embarrassment—and inaccuracy—of stale info again.

Common Scenario #2. You're representing the buyer for the sale of a home. Your client remits $300,000 to pay off the seller's mortgage. Three years later, the buyer is now the seller. The title company found that the lender never recorded a mortgage release for that $300,000—and technically, the lender still has a lien.
Easy Solution 2 : If you have Easy Soft's Easy HUD Software , you've got the information for the fix right in your current software. There's no need to send a paralegal to a cold dark storage facility, or spend a late night going through one dinosaur hard drive after another.

Common Scenario #3. The lender overcharged his mortgagee by something small and undetectable: say $50. This mistake is discovered at the closing. With the new RESPA rules, you can't just write a check for $50 to fix it—you've got to file an amended HUD settlement statement.

Easy Solution 3 : If you have Easy Soft's Easy HUD Software , you can generate a new HUD closing statement faster than you can say “fifty bucks.” You shred the old and voila! Problem solved.

In most cases, our law office software performs any necessary calculations on your behalf. This prevents simple yet costly numerical mistakes—such as one that would be paid out over the course of years (in divorce settlements), one that would affect your title (in a HUD 1 situation), or one that would jeopardize your good standing with your state's attorney ethics department (in terms of your trust fund accounting).

Using Trust Accounting Software to Demystify 3-Way Reconciliation

There's a good reason you didn't go to business school. Or become an accountant. As you look at your state's Rule Book, and read the same sentence four times, you know exactly what that reason is. You don't like numbers, and you never will.

So when you look at your bar's requirement to perform a three-way reconciliation, you're peeved. Luckily, our trust fund accounting software makes things super easy. It does what all good automation systems should. It takes out the thought process, and just mechanizes everything.

What is a 3-Way Reconciliation?

Well, you know what a reconciliation is. You take one balance, and compare it to another, and make sure they're the same. What that means is: nothing's been left out in the cold, or over-added, or taken out of left field. To mix metaphors.

A typical reconciliation involves pitting your book balance (which shows payments made and received, etc.) against your bank balance (which shows actual money being moved around).

Now, pay attention. A 3-way reconciliation adds one additional element. It adds your individual client ledgers. That way, if there is a discrepancy, you can spot it immediately. Or, you can settle in your mind that everything's peachy this month.

So what does trust accounting software have to do with it?

Simple. Enter the numbers once into Easy Soft's Easy Trust software , and the software generates all the numbers for you. You don't have to think about it, or figure out how to do it: you just have to remember to do it. With the click of your mouse, it's there!

Easy, right? We know
